These terms apply when you use growifylabs.com, our client portal or our tools.
1. Who we are
This website is operated by GrowifyLabs, a trading name of Dirk Schembri that holds VAT MT28214733. We are based in Malta. You can contact us at info@growifylabs.com.
In these terms, "we" and "us" mean GrowifyLabs.
2. Scope
These terms cover:
- this website, growifylabs.com;
- our client portal at growifylabs.wayfront.com;
- our tools, including GrowifyLabs Outreach, the app we use to prepare and track outreach emails from our own Gmail mailboxes.
3. Business services only
Our services are for businesses only. We do not offer them to consumers.
Each engagement is governed by its signed proposal or agreement. Where that document and these terms differ, the proposal or agreement prevails.
4. Your responsibilities as a client
- Give us accurate information and the access we need to do the work.
- Hold any licences, registrations or approvals your markets require, for example in iGaming or financial services, and make sure your products and promotions are lawful where you offer them.
- Make sure the content, websites and materials you ask us to work with do not infringe anyone's rights or break the law.
5. Acceptable use
When you use our website, client portal or tools, you must not:
- use them for anything unlawful, fraudulent or harmful;
- try to gain unauthorised access to them, or to accounts or data that are not yours;
- interfere with their security or operation, for example by introducing malicious code or overloading them;
- copy or reuse our content for commercial purposes without our written permission.
We may suspend access to the client portal if we reasonably believe these terms have been breached.
6. Intellectual property
The content of this website, including its text, graphics and code, belongs to us or our licensors. The GrowifyLabs name and logo are our trademarks. You may not use them without our written permission.
7. Third-party sites and services
Our website and services link to and rely on third-party websites, platforms and services, such as search engines, publishers and the providers listed in our Privacy Policy. We do not control them and are not responsible for their content, availability or practices. Content placed on a third-party website remains under the control of that website's owner.
8. No guaranteed results
Search engines and AI platforms decide rankings and visibility themselves, and they change how they work without notice. We do not guarantee specific rankings, traffic, visibility or other results.
9. Limitation of liability
The information on this website is general information, not advice for your situation, and is provided as it is.
To the extent the law allows:
- we are not liable for indirect or consequential loss, or for loss of profits, revenue, business, data or goodwill;
- our total liability in connection with an engagement is limited to the fees you paid us for the services that gave rise to the claim, unless the engagement's proposal or agreement sets a different limit.
Nothing in these terms limits any liability that cannot be limited by law.
10. Privacy
Our Privacy Policy explains how we handle personal data, including Google user data handled by GrowifyLabs Outreach.
11. Governing law and courts
These terms are governed by the laws of Malta. The courts of Malta have exclusive jurisdiction over any dispute arising from them.
12. Changes to these terms
We may update these terms. The date at the top shows when they were last updated, and the version published here applies from that date.
